As a private provider of digital intermediary services and thus a service provider within the meaning of § 2 paragraph 4 of the Accessibility Strengthening Act (BFSG), Marktplatz Mittelstand GmbH & Co. KG strives to make its digital offerings under the “Firmenweb” brand and the related web services accessible in accordance with the applicable accessibility requirements.

Since www.firmenweb.de and the aforementioned web services of the “Firmenweb” brand are offerings of a private company and not those of a public body as defined in § 2 paragraph 1 of the Equal Opportunities for Disabled Persons Act (BGG), there is no direct obligation to apply the Accessible Information Technology Ordinance (BITV 2.0).

This statement refers to all content published under the domain www.firmenweb.de and the mentioned web services, as well as associated web applications on the internet, intranet, and extranet, to the extent that they fall under the responsibility of Marktplatz Mittelstand GmbH & Co. KG. It applies regardless of the device used to access the services – whether desktop computers, laptops, tablets, or mobile devices such as smartphones.

The digital services are largely compliant with the requirements of the harmonized European standard EN 301 549 V3.2.1 (03-2021), which is considered the relevant technical standard for accessible design of information and communication technology under § 3 of the BFSG. Some content or functions may currently still present barriers. These known barriers are gradually being removed within the scope of technical and economic feasibility.

Compliance Status with the Requirements

Currently, the digital offerings at www.firmenweb.de nd the domains listed above are being revised technically and structurally in order to gradually implement the requirements of the harmonized standard EN 301 549 V2.1.2 (08-2018).

As part of these measures, a technical preliminary assessment was conducted on March 28, 2025, using the Screaming Frog analysis tool by the agency ebusinesslab. The analysis was used to identify potential barriers and structural weaknesses. A comprehensive accessibility assessment according to the criteria of EN 301 549 has not yet been carried out and is planned for a later stage of the project.

The technical optimization points identified so far are currently being addressed and implemented step by step. The goal is to align and further develop the digital offerings of Firmenweb and its associated services to be as accessible as possible.

Public Website Area

  • The YouTube videos embedded in the “Media” section are not fully operable via keyboard in all cases. (Success Criterion 2.1.1 – Keyboard)
  • A skip link to bypass the page header and jump directly to the main content is currently not implemented. (Success Criterion 2.4.1 – Bypass Blocks)
  • Some text sections are not semantically structured correctly. Headings are sometimes styled visually but not technically implemented – for example, using container elements like <div> instead of semantic heading tags such as <h1> to <h6>. (Success Criterion 1.3.1 – Info and Relationships)
  • Contact images that show people do not include individual alternative texts that describe the visual representation. (Success Criterion 1.1.1 – Non-text Content)
  • Various interactive elements such as sliders, buttons, icons, or navigation components are not fully accessible via keyboard. (Success Criteria 2.1.1 – Keyboard, 2.4.3 – Focus Order, 4.1.2 – Name, Role, Value)
  • Elements like <strong> or <br> are used in places where semantically richer HTML tags such as <h2> or structured lists would be more appropriate. (Success Criterion 1.3.1 – Info and Relationships)
  • Some forms lack a clear explanation for required fields, for example, a hidden screen reader label for the asterisk symbol "*". (Success Criterion 3.3.2 – Labels or Instructions)
  • In some cases, ARIA markup is not correctly implemented:
    • <img> uses aria-label instead of alt
    • Popups use aria-expanded without being properly associated with target element
    • Dialog triggers are implemented using <div> elements instead of <button>.
(Success Criteria 4.1.2 – Name, Role, Value, 4.1.3 – Status Messages)
  • Embedded PDF documents have not yet been fully reviewed for compliance with the PDF/UA standard. (According to EN 301 549, Section 10)
  • Some container elements (e.g. <div>) are styled to act as links or buttons, but are neither semantically correct nor keyboard accessible. (Success Criteria 2.1.1 – Keyboard, 4.1.2 – Name, Role, Value)
  • The HTML structure includes isolated instances of inaccessible nesting, such as <div> elements within <dl> (Definition Lists). This can cause incorrect output for screen reader users. (Success Criterion 1.3.1 – Info and Relationships)

Planned Changes

The deficiencies in accessibility identified during the review will be incorporated into ongoing quality assurance and rectified within the scope of technical capabilities.

Dispute Resolution Procedure

If, after your feedback to us, you do not receive a satisfactory solution regarding the accessibility of our digital services, we would like to inform you that – even as a user of private services – you may voluntarily contact the conciliation body under § 16 of the Equal Opportunities for Disabled Persons Act (BGG).

The BGG conciliation body aims to support out-of-court dispute resolution in cases of accessibility conflicts between people with disabilities and providers of digital services – even if they do not belong to public federal institutions. The conciliation procedure is free of charge and does not require legal counsel.

This notice also follows the provisions of Directive (EU) 2019/882 on accessibility requirements for products and services, whose recital 99 recommends establishing and publicizing such alternative dispute resolution procedures.

Further information about the conciliation procedure and options for submitting a request is available at: https://www.schlichtungsstelle-bgg.de
